StatusMonkey provides website and API uptime monitoring and notifications (email and/or SMS). Optional public status pages may be available, including whitelabeled pages on a custom domain. We may modify or discontinue features at any time.
3) Accounts & Responsibilities
- You must provide accurate information and maintain the security of your credentials.
- You are responsible for activity that occurs under your account.
- You will not misuse the Service, probe or scan systems, interfere with monitoring, or violate applicable laws.
4) Notifications; Third‑Party Networks
Email and SMS delivery depend on third‑party networks and carriers. We are not liable for delays, failures, or charges imposed by your email provider or carrier.
5) Plans, Billing & Refunds
- Certain features are paid. Fees are billed in advance on a subscription basis and are non‑refundable except where required by law.
- We may change prices with reasonable prior notice. Continued use after price changes constitutes acceptance of the new pricing.
- Taxes, if applicable, are your responsibility.
6) Usage Limits
Plan limits (e.g., number of URLs, check intervals, and SMS quotas) may apply. We may enforce reasonable rate limits and fair‑use protections to maintain service quality.
7) Customer Content
You retain ownership of content you submit (e.g., monitored URLs, status text). You grant us a limited license to process this content solely to provide the Service. You are responsible for ensuring you have rights to submit all content.
8) Integrations & APIs
Use of our API or integrations (e.g., Slack, webhooks) is subject to these Terms. We may throttle or revoke API access to preserve platform stability.
9) Intellectual Property
The Service, including software and branding, is owned by StatusMonkey and its licensors. Except for the rights expressly granted, no license is implied.
10) Beta & Experimental Features
Beta features are provided “as is,” may be modified or discontinued at any time, and may be excluded from support or uptime commitments.
11) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.
12) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL STATUSMONKEY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNTS PAID BY YOU TO US FOR THE SERVICE IN THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
13) Indemnification
You will indemnify and hold StatusMonkey harmless from claims arising out of your misuse of the Service or violation of these Terms.
14) Suspension & Termination
We may suspend or terminate your access if you violate these Terms or if your use poses a risk to the Service. You may cancel at any time; cancellations take effect at the end of the current billing period.
15) Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict‑of‑law rules. Venue lies exclusively in San Francisco County, California.
16) Changes to Terms
We may update these Terms from time to time. Material changes will be posted here with a new effective date. Continued use after changes means you accept the updated Terms.
